Agreement

By using E&E Outreach ("the Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service. These Terms form a binding agreement between you and E&E Outreach LLC ("E&E Outreach", "we", "us", or "our").

The Service

E&E Outreach is software that helps small businesses send AI-generated follow-up emails and text messages to their customers. We provide the tools; you provide the customer list and approve messages before they're sent.

Account Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement. You agree to provide accurate information when creating your account and to keep it up to date.

Your Responsibilities

• You are responsible for the customer data you upload. You must have the legal right and consent to contact those customers.
• You are responsible for complying with anti-spam laws including the CAN-SPAM Act, TCPA, GDPR, and any other applicable regulations in your jurisdiction.
• You must not use the Service to send spam, harassment, illegal content, or messages to anyone who has not opted in to hear from your business.
• You are responsible for keeping your account credentials secure.
• You must review and approve messages before they are sent. The AI assists you but you make the final decision.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Send messages that are deceptive, harassing, threatening, defamatory, or obscene.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Resell or sublicense the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these rules.

Pricing and Billing

• Plans are billed monthly. Pricing is shown on our pricing page.
• All plans include a 30-day free trial. No credit card is required to start.
• You can cancel at any time. Cancellation takes effect at the end of your current billing cycle.
• We do not offer refunds for partial months.
• We may change pricing with 30 days' notice. Existing subscribers will be notified by email.

Free Trial

The 30-day free trial gives you full access to the plan you select. If you don't upgrade to a paid plan by the end of the trial, your account will be paused. Your data is kept for 30 days after the trial ends in case you want to upgrade later.

Data and Ownership

You own your data. We own the Service. You grant us a limited license to process your data in order to provide the Service to you. See our Privacy Policy for details on how we handle your data.

AI-Generated Content

The Service uses Claude (by Anthropic) to generate message drafts. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing every message before it is sent. We are not liable for any consequences of messages you approve and send.

SMS Messaging Program

Program name: E&E Outreach Messaging Program.

Program description: E&E Outreach enables small businesses to send customer follow-up, appointment reminder, and re-engagement text messages to their own existing customers. Messages are sent only to recipients who have a prior business relationship with the sending business and who provided their mobile number to that business during booking, intake, or prior service.

Message frequency: Message frequency varies depending on the sending business and the recipient's relationship with that business. Recipients typically receive no more than a few messages per month.

Message and data rates: Message and data rates may apply. Your mobile carrier may charge you for each message sent or received according to your plan. E&E Outreach does not charge recipients for messages; any fees come from your mobile carrier.

Opt-out instructions: You can cancel the SMS service at any time. To opt out, reply STOP to any message you receive from us. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. After you send one of these keywords, we will send you a confirmation message and you will not receive any additional messages unless you opt back in. If you want to re-join, reply START.

Help: If you experience issues with the messaging program, reply HELP for assistance, or contact support directly at support@eeoutreach.com. You can also get help from the small business that sent you the message by replying to any text you received.

Carriers: Carriers are not liable for delayed or undelivered messages.

Privacy: See our Privacy Policy for details on how we handle data collected through the SMS program. No mobile information or SMS opt-in data will be shared with third parties or affiliates for marketing or promotional purposes.

Service Availability

We strive to keep the Service available 24/7 but make no guarantees. We may need to perform maintenance, fix bugs, or address issues that cause temporary downtime. We are not liable for losses caused by service interruptions.

Termination

You can cancel your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that harms us or other users. Upon termination, your data will be deleted within 30 days unless we are required by law to keep it.

Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

Limitation of Liability

To the maximum extent permitted by law, E&E Outreach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to indemnify and hold us harmless from any claims arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party (including the people you message).

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice in the dashboard. Continued use of the Service after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
